This one goes out to all of my prosecution cohorts. Crafting an identification of goods and services for a new trademark application can be a trying task. In this world of better mousetraps and winsome widgets, you can tinker and toy with possible IDs until smoke comes out of your ears. Sometimes, you head to the Manual thinking to yourself, “Surely, this item will have a pre-approved ID!” only to find out no such ID exists.
The PTO powers that be have a solution to your problem. If you think there’s an ID missing from the Manual, you can email the suggestions team and propose that it be added.
So, you ask, does it work? How long does it take? The answers are (i) yes, and (ii) a surprisingly short amount of time. I emailed my proposed ID on a Friday, and by Monday I had received a note stating that my proposed ID will be added to the Manual in three days’ time.
The process is pretty straightforward: submit your name, email address, and proposed ID. (Mind you, you can’t propose an ID that’s been rejected by an Examining Attorney.)
